Existing Rules Review
At least every 10 years, we are required to review all of our rules in a formal process called Existing Rules Review. The deadlines for review of our rules are set by an independent commission appointed by the General Assembly – the Rules Review Commission.
The Process: We will classify each of our rules as either necessary or unnecessary. We will post our classifications below and accept public comment for 60 days. We will complete the classification spreadsheet with a general response to public comments we receive. We then submit the completed spreadsheet to the Rules Review Commission for their review.

The schedule for our next ERR review has now been set by the Rules Review Commission. The deadlines for review of our rules by the Commission are:
September 2024: 18 NCAC 05 (UCC); 18 NCAC 06 (Securities); 18 NCAC 10 (Electronic Commerce);
18 NCAC 07J (Notary) has been moved to June 2025 (Review Completed)
January 2025: 18 NCAC 02 (Trademark Registration; 18 NCAC 08 (Land Records Management);
18 NCAC 11 (Solicitation Licensing); 18 NCAC 12 (Lobbying) (Review Completed)
October 2025: 18 NCAC 01 (Departmental Rules); 18 NCAC 04 (Business Registration); 18 NCAC 13 (State Franchise for Cable Television Service) (Review Completed)

The Department is requesting early RRC review of these classification reports.
